The meeting was held in the Leon County Courthouse, County Commission Chambers, Fifth Floor, located at 301 S. Monroe Street, Tallahassee, Florida 32301.

The media and the public could access the meeting in real time on Comcast channel 16, the Leon County Florida channel on Roku, the County’s Facebook page, YouTube channel, Twitter and County web site.

Citizens wishing to provide input on any item(s) on the published agenda (or a non-agenda subject) for the meeting could share public comment by using one of the following options:

The following speakers provided in-person comment:

• Mr. Rene Perez commented on a notification he and his neighbors received regarding a variance request for using Selina Road, a county road, for heavy machinery to access a sand mine off this road.
• Ms. Kathy Davis commented on the variance request brought up by the previous speaker and noted several issues with incorrect details on the public notification that caused delays in contacting County staff regarding this matter.
• Reverend Sylvia Jones, on behalf of Capital Area Justice Ministry, congratulated all the Commissioners who were sworn in today. She then relayed a message on behalf of a local teacher regarding children enrolled in the Leon County School system who are struggling with unstable housing environments or homelessness.
• Ms. Latricia Scrimen, Sr. Pastor at St. Paul United Methodist Church, Co-Paster and Co-President of Capital Area Justice Ministry, commented on homeless children in Leon County. She noted the positive action that Leon County has taken in the recent past to assist with affordable housing, and she asked the County step up again and take additional steps to address this issue.
• Mr. Robert Gibbs commented on the lack of dedicated funding that could assist with affordable housing in Leon County. He asked that Leon County take action to support funding for extremely low and very low-income families in Leon County.
• Ms. Jimmie Dicky, Pastor of Greater Tanner Chapel AME of Quincy, commented on the need for affordable housing in Leon County. She echoed the comments of previous speakers requesting additional funding for affordable housing in Leon County.

4. Approval of Agreements with Legal Services of North Florida, Inc. and The Legal Aid Foundation of the Tallahassee Bar Association, Inc. to Provide Legal Aid Services in Leon County

   The Board approved Option #1: Approve the Agreements with Legal Services of North Florida, Inc. (Attachment #1), and The Legal Aid Foundation of the Tallahassee Bar Association, Inc. (Attachment #2), to provide legal aid services in Leon County, and authorize the County Administrator to execute the Agreements, and any amendments thereto, subject to legal review by the County Attorney.
    
5. Update on the County’s Upcoming Courthouse Renaming and Dedication in Honor of Judge Augustus D. Aikens, Jr.

   The Board approved Option #1: Accept the update on the County’s planned actions for the Leon County Courthouse Renaming and Dedication Ceremony in honor of Judge Augustus D. Aikens, Jr., including the installation of a portrait, legacy plaque, new signage, and the unveiling of prominent exterior dedication lettering during the ceremony; and
    
6. Request to Reschedule Workshops on the Southside Action Plan and the Comprehensive Plan Land Use & Mobility Elements Update

   The Board approved Option #1: Reschedule the Workshops on the Southside Action Plan and the Comprehensive Plan Land Use & Mobility Elements Update, for Tuesday, February 25, 2025, at 2:00 p.m. and 3:00 p.m., respectively.

7. Fiscal Year 2025 Agreement for the Provision of State-Mandated Baker Act and Marchman Act Services
   (County Administrator / Human Services & Community Partnerships)
   The Board approved Option #1: Approve the Agreement with Apalachee Center, Inc. for Baker Act and Marchman Act state-mandated services for FY 2025 (Attachment #1) and authorize the County Administrator to execute the Agreement, and any future amendments, subject to legal review by the County Attorney.
    
8. Fiscal Year 2025 Healthcare Services (CareNet) Program Agreements
   (County Administrator / Human Services & Community Partnerships)
   The Board approved Option #1: Approve the FY 2025 Agreements with Bond Community Health Center, Inc., Neighborhood Medical Center, Inc., Apalachee Center, Inc., Capital Medical Society Foundation, Inc., and the Florida A&M University College of Pharmacy and Pharmaceutical Sciences Institute of Public Health, to provide healthcare services for qualified County residents (Attachments #1, #2, #3, #4 and #5), and authorize the County Administrator to execute the Agreements, and any amendments thereto, subject to legal review by the County Attorney.
    
9. Memorandum of Understanding with Apalachee Center, Inc. for the Forensic Intervention and Re-entry Services Team
   (County Administrator / Office of Intervention and Detention Alternatives)
   The Board approved Option #1: Approve the Memorandum of Understanding with Apalachee Center, Inc. (Attachment #1) to provide in-kind contribution for the Criminal Justice Mental Health Substance Abuse Reinvestment Grant and authorize the County Administrator to execute all associated documents, and any amendments thereto, subject to legal review by the County Attorney.
    
10. Resolution Authorizing Conveyance of a Portion of a County-owned Parcel to the City of Tallahassee for the Development of the Blueprint Orange/Meridian Placemaking Park and Recreational Trails

    The Board approved Option #1: Adopt the Resolution authorizing the conveyance of a portion of the County-owned parcel located at 401 Orange Avenue East, parcel identification number 411203A0020, to the City of Tallahassee for the development of the Blueprint Orange/Meridian Placemaking Park and Recreational Trails (Attachment #1); and
    Option #2: Authorize the Chair to execute a County Deed (Attachment #2) and any associated documents, subject to legal review by the County Attorney.
     
11. Approval of a Master Agreement with Florida Gulf & Atlantic Railroad, LLC for Railroad Crossing Repairs

    The Board approved Option #1: Approve of the master agreement between Florida Gulf & Atlantic Railroad, LLC and Leon County (Attachment #1), and authorize the County Administrator to execute the Agreement, and any amendments thereto, subject to legal review by the County Attorney.
     
12. PULLED – Florida Department of Transportation Off System Bridge Project Agreement for the Replacement of the Springhill Road Bridge over Munson Slough

Request to Schedule the First and Only Public Hearing Regarding Intent to Use the Uniform Method for the Levy, Collection, and Enforcement of Non-Ad Valorem Assessments for the Purpose of Collecting the Full Amount of all Charges Related to Sewer Service Imposed on Certain Real Property Located on Woodville Highway and Lewis Boulevard, for December 10, 2024

    The Board approved Option #1: Schedule the first and only public hearing regarding the County’s intent to utilize the Uniform Method for the levy, collection, and enforcement of Non- Ad Valorem Assessments for the purposes of collecting the full amount of all charges related to Sewer Service imposed on certain real property located on Woodville Highway and Lewis Boulevard for December 10, 2024, at 6:00 p.m.
     
14.     The Board approved Option #1: Approve the award for the home demolition and reconstruction project to Arris General Contractors Inc. in the total amount of $264,250 to replace the eligible home located at 8142 Blackjack Road (Attachment #1), and authorize the County Administrator to execute the Agreement, and any amendments thereto, subject to legal review by the County Attorney.
     
16. Approval to Purchase an Ambulance for Emergency Medical Services
    (County Administrator / Public Works)
    The Board approved Option #1: Approve the purchase of one new ambulance utilizing the Florida Sheriffs Association Purchasing Agreement, Contract #FSA23-VEF 17.0, Item 589, from Matheny Fire & Emergency in the amount of $362,900.
     
17. Approval to Purchase Furniture for the Main Library Improvements – Second Floor Project
    (County Administrator / Public Works)
    The Board approved Option #1: Approve the purchase of furniture for the Main Library Improvements – Second Floor project from Perdue, Inc., utilizing a cooperative purchasing process with New York State – Office of General Services Contract 23295, in an amount not to exceed $574,692.

12. Florida Department of Transportation Off System Bridge Project Agreement for the Replacement of the Springhill Road Bridge over Munson Slough
    (County Administrator / Public Works)

• • This item was pulled by Commissioner Proctor.
  • Commissioner Proctor noted his concern for this project proposal. He suggested that there is not enough data for him to support this proposal to move forward.

Commissioner Maddox moved, seconded by Commissioner Minor, to approve Option #1: Adopt the Resolution and approve an Off-System Agreement with FDOT for the construction of the Springhill Road Bridge over Munson Slough, authorizing the County Administrator to execute the agreement, in a form approved by the County Attorney, and consenting and authorizing FDOT to do all acts necessary, including securing all environmental and regulatory permits, easements, temporary construction easements, and rights of entry associated with the project.

The motion passed 6-1 with Commissioner Proctor in opposition.

GENERAL BUSINESS

18. Ratification of Board Actions Taken at the October 22, 2024 Workshop on Leon County Policy No. 96-1, “Purchasing Policy”
    (County Administrator / Purchasing)
    Commissioner Maddox moved, seconded by Commissioner Minor, to approve Option #1: Ratify the actions taken at the October 22, 2024 Workshop on Leon County’s Purchasing Policy and adopt the proposed revisions to Leon County Policy No. 96-1, “Purchasing Policy”.
    The motion passed 7-0.
     
19. Ratification of Board Actions Taken at the October 22, 2024 Workshop on the 2025 State and Federal Legislative Priorities
    (County Administrator / County Administration)

• • Commissioner Proctor noted support for the RFP and asked that any new firms hired by the County work with the existing firms to ensure a seamless approach to lobbying for County priorities. He also noted support for evaluating the Federal Lobbying contract at the next available opportunity.

Commissioner Maddox moved, seconded by Commissioner Minor, to approve Option #1: Ratify the actions taken by the Board at the October 22, 2024 Workshop on the 2025 State and Federal Legislative Priorities; and
Option #2: Approve the Budget Amendment in the amount of $40,000 for the issuance of a Request for Proposals seeking additional state lobbying services for the 2025 State Legislative Session (Attachment #1).
The motion passed 7-0.

20. Approval to Award Agreements for Public Relations and Digital Advertising Services
    (County Administrator / Tourism)
    Commissioner Maddox moved, seconded by Commissioner O’Keefe, to approve Option #1: Approve awarding an Agreement for the provision of public relations services to The Zimmerman Agency, LLC and authorize the County Administrator to execute the Agreement (Attachment #1), and any amendments thereto, subject to legal review by the County Attorney; and
    Option #2: Approve awarding an Agreement for the provision of digital marketing and advertising services to The Zimmerman Agency, LLC and authorize the County Administrator to execute the Agreement (Attachment #2), and any amendments thereto, subject to legal review by the County Attorney.
    The motion passed 7-0.
     
21. Full Board Appointment to the Tourist Development Council
    (County Administrator / Administration)
    Commissioner Maddox moved, seconded by Commissioner Cummings, to approve Option #1: Appoint one eligible applicant, Michelle Personette, to the tourism industry seat on the Tourist Development Council for a four-year term ending October 31, 2028. Should the Board choose to appoint Ms. Personette, it would be necessary for the Board to waive the conflicting employment relationship disclosed on Form 4A (Attachment #1) by a two-thirds affirmative vote.
    The motion passed 7-0.

22. First and Only Public Hearing to Consider Abandoning a Portion of Singleton Drive Right-of-Way
    (County Administration / Development Support & Environmental Management)
    Commissioner Minor moved, seconded by Commissioner Cummings, to approve Option #1: Conduct the first and only public hearing and adopt the Resolution to abandon the platted, unimproved 0.18-acre portion of Singleton Drive right-of-way (Attachment #1).
    The motion passed 7-0.
     
23. First and Only Public Hearing to Consider an Ordinance to Amend Chapter 6, Sections 6-32 and 6-34 of the Leon County Code of Laws, Related to Hearing Procedure and Administrative Fines and Liens, and Chapter 14, Section 14-56 of the Leon County Code of Laws, Related to Appeals
    (County Administration / County Attorney)

• • Commissioner Proctor noted concern regarding the fines established by the Ordinance. He opposes imposing liens on personal property and real estate other than the subject property.
  • County Attorney O’Steen responded that the existing ordinance allows for the imposition of liens on subject property and other personal property in accordance with state law. The other proposed revisions provide additional due process time for individuals. She added that the recommended changes for the Nuisance Abatement Board provide extra time for an individual to file an appeal.
  • Commissioner Proctor noted his opposition for liens to be placed on personal property and on real property other than the subject property in these situations. He requested the County eliminate that option from the proposed Ordinance.

Commissioner Proctor moved, seconded by Commissioner O’Keefe, to adopt the proposed ordinance with an amendment to remove the ability for liens to be placed on real property other than the subject property and personal property.

• • Commissioner O’Keefe asked for confirmation that this has always been in the Ordinance.
  • County Attorney O’Steen confirmed that detail.
  • Commissioner Maddox suggested that the public have an opportunity to comment on revisions to the Ordinance and recommended that the motion be amended to direct staff to prepare a new proposed Ordinance to be considered at a future Public Hearing.

Commissioner Proctor withdrew his original motion and made a new motion, seconded by Commissioner O’Keefe, to direct staff to prepare a new proposed Ordinance removing the language allowing liens to be placed on real property other than the subject property and personal property and continue this item until the January 28, 2025 meeting.
The motion passed 7-0.

  • Mr. Robert Deyle, Member of Capital Area Justice Ministry, reiterated the message from speakers earlier on the need for affordable housing in Leon County. He asked the Board to direct staff to prepare an agenda item to reallocate County sales tax revenues to affordable housing.

• He thanked the Board for electing him Vice Chairman.
• He asked the County Administrator for additional information on the topic of a new sand mine in Leon County that a few speakers mentioned earlier in the meeting.
• County Administrator Long responded that the sand mine brought up by two speakers was previously scheduled to be presented at a Board of Adjustment and Appeals (BOAA) meeting, causing a notice to be sent out to residents in that particular area. However, the item was pulled off the BOAA meeting agenda in order for staff to conduct additional due diligence on the proposal. If this item is rescheduled for a future BOAA meeting, the Board will be notified.

• He asked if the railroad crossing at Hartsfield Road could be reviewed by staff since it was not included on the list.
• Mr. Charles Wu, Director of Engineering with the Public Works Department, responded that Hartsfield Road is a City roadway so it is not included in the Master Agreement with Florida Gulf & Atlantic Railroad, LLC (agenda item #11) but that staff will look into the request and provide a follow up email.

Commissioner Cummings

• She noted receipt of a thank-you letter from Reverend Quincy Griffin regarding County participation in the Shoes for Schools drive.
• She recently attended a Bicentennial dedication event where the County was presented with a recognition plaque for the County’s support of Tallahassee – Leon County’s Bicentennial.
• She requested a proclamation for Pastors Gerald and Judy Mandrell recognizing the 30th Anniversary of Life Changers Church of God in Christ.

Commissioner Cummings moved, seconded by Chairman Welch, to present a proclamation for Pastors Gerald and Judy Mandrell recognizing the 30th Anniversary of Life Changers Church of God in Christ.

• He congratulated the new Chairman and Vice Chairman and all the Commissioners who won re- election.
• He thanked Commissioner Minor for all of his efforts at the Florida Association of Counties (FAC) meetings.

• He thanked Public Works staff for Consent Agenda Item #11 regarding railroad crossing improvements in Leon County.
• He requested a proclamation recognizing Riccardos restaurant celebrating their 25th anniversary.

Commissioner Minor moved, seconded by Commissioner Proctor, to provide a proclamation to Riccardos restaurant celebrating their 25th Anniversary.

The motion passed 7-0.

Staff: Administration – Regina Glee

• He mentioned a letter that he brought up at the October Board meeting regarding Florida joining the Southern Rail Commission. He passed around the draft letter that is intended to be distributed to the Governor and Legislature requesting their support for Florida joining the Southern Rail Commission in order to initiate bringing passenger rail service to North Florida. He asked Commissioners for their willingness to add their individual signatures in support of the request letter.

Commissioner Minor moved, seconded by Commissioner Maddox, to add signatures of all the Commissioners to the support letter which will be distributed to the Governor and Legislature regarding Florida joining the Southern Rail Commission.

The motion passed 7-0.

• He wished everyone a Happy Thanksgiving.

Commissioner O’Keefe

• He thanked the entire Leon County Division of Tourism team for landing the recent concert of Tallahassee native T-Pain at the Adderley Amphitheater. He noted the Division of Tourism’s work to bring music festivals and concerts to Leon County.
• He thanked Capital Area Justice Ministry for bringing the topic of affordable housing in Leon County to the Board and expressed his desire to support a motion on their proposal.
• He commented on the news of a pedestrian fatality in Leon County caused by a vehicle. He suggested that Leon County look to other states and counties that have achieved success in reducing and preventing these types of fatalities.
• Commissioner Cummings asked if there is a jurisdictional challenge with accidents inside the city limits compared to Leon County.
• County Attorney O’Steen noted that depending on the program or proposal, there may be jurisdictional challenges that the Board would need to coordinate with other entities such as the City of Tallahassee and the Florida Department of Transportation.

Commissioner O’Keefe moved, seconded by Commissioner Proctor, to bring an agenda item to the Board on actionable ways to reduce and prevent pedestrian and vehicular accidents and fatalities.

The motion passed 7-0.

• Commissioner O’Keefe noted the need for additional affordable housing in Leon County.

Commissioner O’Keefe motioned, seconded by Commissioner Proctor, to direct staff to work with Capital Area Justice Ministry (CAJM) to bring back an agenda item on CAJM’s proposal to set aside a portion of County sales tax revenues for affordable housing along with an implementation plan for a land acquisition and leaseback program modeled after the Penny for Pinellas Land Assembly Fund.

• County Administrator Long suggested a two-step approach to facilitate the Board’s consideration of CAJM’s proposal. The first step would be an agenda item and analysis on the County’s use of sales tax funds in support of the Capital Improvement Program, information on County programs, available incentives, challenges related to affordable housing, and the Penny for Pinellas Land Assembly Fund. Should the Board wish to proceed with creating a new affordable housing incentive program, the second step would be to prepare a budget discussion item that outlines the program and provides the necessary resources for implementation.

Commissioner O’Keefe amended his motion, seconded by Commissioner Proctor, to direct staff to bring back an agenda item with an analysis of CAJM’s proposal to set aside a portion of County sales tax revenues for affordable housing modeled after the Penny for Pinellas Land Assembly Fund.

• Commissioner Cummings asked for an update on the affordable housing agenda item recently requested by Commissioner Maddox.
• Mr. Shington Lamy, Assistant County Administrator, responded that the item regarding transitional housing is scheduled to be provided at the December 10, 2024 Board meeting.

• He noted the recent celebration of the Bond Community Health Center’s 40th Anniversary.

Commissioner Proctor moved, seconded by Commissioner Caban, to bring an agenda item exploring opportunities to establish food distribution and medical services to residents of the Woodville community through the Bond Neighborhood Health Clinic Mobile Unit and the Second Harvest of the Big Bend Mobile Pantries.

The motion passed 7-0.

• He thanked Leon County Public Works staff for participating with his office on October 26th to distribute about 30,000 pounds of food to those in need. He noted the importance of helping individuals who are in need of services throughout the County.
• He offered a pleasant welcome to Chairman Brian Welch and congratulated Commissioner Caban on his election as Vice Chair. He also gave a sincere thank you to outgoing Chair Carolyn Cummings.
• He asked if there are requirements for construction projects that impede roadways to have individuals providing warning flag activity for modification of traffic flow.
• County Administrator Long responded that all County bid jobs that require traffic control are required to have this particular safety measure and suggested that citizens can report violations of this to Public Works.

• He requested a proclamation recognizing Montford Middle School’s football team for winning the District Championship.

Commissioner Maddox moved, seconded by Commissioner O’Keefe, to provide a proclamation to recognize Montford Middle School’s football team for winning the District Championship.

The motion passed 7-0.
