Statement of Issue:

This item seeks Board approval of the plat for Shops at Bannerman Village Subdivision for recording in the Public Record and acceptance of the Infrastructure Completion Agreement.

 

Fiscal Impact:  

This item has no fiscal impact. 

 

Staff Recommendation:

Option #1:       Approve the plat for Shops at Bannerman Village Subdivision for recording in the Public Record (Attachment #1), contingent upon staff’s final review and approval, and authorize the County Administrator to accept and execute the Infrastructure Completion Agreement (Attachment #2), and any future extensions thereto.

 

 

 

Report and Discussion

 

Background:

In accordance with Leon County land development regulations, this item seeks Board approval of the plat for Shops at Bannerman Village Subdivision for recording in the Public Record.  The development being platted consists of 10.34 acres containing 4 commercial lots.  Shops at Bannerman Village Subdivision is located in Sections 8; Township 2 North; Range 1 East, on the south side of Bannerman Road east of Bull Headley Road (Attachment #3). 

 

Shops at Bannerman Village Subdivision, aka Cawthon Commercial, was originally approved by the Development Review Committee as a Type “B” site and development plan on October 21, 2021 (Attachment #4).  

 

In accordance with Chapter 10, Article VII, Division 6 of the Leon County Code of Laws, a plat submitted to the Board of County Commissioners for approval must meet all requirements of Chapter 10 and be certified by the County Engineer.  Once approved, the original approved plat will be forwarded to the Clerk of Court for recording in the Public Record.

 

Analysis:

The applicant, Boos-Bannerman Tallahassee I, LLC, is requesting Board approval of the plat contingent upon staff’s final review and approval due to date-sensitive contractual obligations.  The plat has been circulated and is still under review by the appropriate departments and agencies.  The plat presented herein is a conditional final plat in that it is substantially complete, and staff does not anticipate any changes other than possible minor corrections to text.

 

This is a private commercial subdivision with private infrastructure.  Some of the private infrastructure has yet to be completed.  Public Works Engineering has reviewed these items and inspection reports and recommends an Infrastructure Completion Agreement and Surety Device in the amount of $309,301, representing 110% of the certified construction cost approved by the Division of Engineering Services to ensure that the infrastructure is completed as permitted.  No Certificates of Occupancy will be issued for the buildings on site until all infrastructure is complete, utilities are accepted, and all permits have been closed out.  This item seeks Board authorization for the County Administrator to accept and execute the Infrastructure Completion Agreement.

 

The term of the Infrastructure Completion Agreement and Surety Device is 30 days.  Should the developer require an additional 30 days to complete the infrastructure, this items also seeks Board authorization for the County Administrator to approve and execute any extension needed to the Infrastructure Completion Agreement.

 

Staff recommends the Board approve the plat for recording upon completion of the final review and approval from reviewing departments and agencies.  Should there be a need for any substantive changes to the plat, staff will resubmit the plat to the Board for approval at a future meeting.

 

 

Options:

  1. Approve the plat for Shops at Bannerman Village Subdivision for recording in the Public Record (Attachment #1), contingent upon staff’s final review and approval, and authorize the County Administrator to accept and execute the Infrastructure Completion Agreement (Attachment #2), and any future extensions thereto.
  2. Do not approve the plat for Shops at Bannerman Village Subdivision for recording in the Public Record.
  3. Board direction.
